1. About Us

These Terms & Conditions govern your use of archersaiops.com and any services, forms, phone numbers, or messaging programs operated by Archers AI Ops LLC, a Washington limited liability company ("Archers AI Ops," "we," "us," or "our").

Archers AI Ops provides AI automation and marketing services to small and local businesses, including CRM setup and configuration, missed-call text-back, speed-to-lead follow-up, appointment booking automation, reputation and review management, and Google Business Profile optimization.

By using our website, submitting a form, or texting one of our business numbers, you agree to these Terms.

2. SMS / Text Messaging Program Terms

Program description. Archers AI Ops LLC operates a text messaging program to communicate with prospective and existing customers. We send two distinct categories of messages, and you consent to each separately:

Non-marketing (transactional and conversational): appointment reminders and confirmations, scheduling changes, quote request follow-ups, missed-call responses, service updates, and replies to questions you have asked us.
Marketing: promotions, special offers, service announcements, and other promotional content.

How you opt in. You opt in by checking the applicable consent box on a form on archersaiops.com, by providing your number and agreeing to receive messages during a call or in person, or by texting one of our business numbers first. Consent boxes are never pre-checked, and each category requires its own separate check.

Consent is not a condition of purchase. You are never required to agree to receive text messages in order to buy any product or service from us.

Age requirement. Our services and our text messaging program are intended for individuals 18 years of age or older. By using our services, submitting a form on our website, or opting in to receive text messages, you confirm that you are at least 18 years old. We do not knowingly collect information from, or send messages to, anyone under 18.

Message frequency. Message frequency varies depending on your interaction with us. Transactional messages are sent as events occur. Marketing messages are sent periodically.

Cost. We do not charge for text messages. Message and data rates may apply based on your plan with your mobile carrier.

How to opt out. Reply STOP to any message from us at any time. You will receive a single confirmation message, after which we will send you no further messages unless you opt in again.

Carrier disclaimer. Carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission by your mobile carrier and is outside our control.

Supported carriers. Our program is supported by major U.S. carriers, including AT&T, Verizon Wireless, T-Mobile, and others. Carrier participation may change without notice.

Privacy. Your mobile information is handled in accordance with our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

3. Services and Engagement

Specific services, deliverables, timelines, and fees are set out in a separate written proposal, statement of work, or service agreement between you and Archers AI Ops. Where those documents conflict with these Terms, those documents control for that engagement.

Nothing on this website constitutes an offer, a guarantee of results, or a binding commitment to provide services. We may decline any engagement.

4. Payment

Fees, billing frequency, and payment terms are set out in your service agreement. Unless stated otherwise:

Recurring service fees are billed monthly in advance
Setup and one-time fees are due before work begins
Late payments may result in suspension of services
Third-party costs passed through to you, such as phone number fees, carrier registration fees, and messaging usage, are your responsibility

5. Your Responsibilities

If we operate messaging, calling, or marketing systems on your behalf, you are responsible for:

Obtaining valid consent from your own contacts before we message them
The accuracy and lawfulness of any contact lists you provide to us
Complying with the TCPA, CAN-SPAM, carrier requirements, and applicable state law
Maintaining your own privacy policy and terms where required

You agree not to use our services to send unlawful, deceptive, harassing, or unsolicited messages.

6. Acceptable Use of This Website

You agree not to:

Use the site for any unlawful purpose
Attempt to gain unauthorized access to our systems or data
Interfere with the operation of the site
Scrape, copy, or reproduce our content without permission

7. Intellectual Property

All content on archersaiops.com — text, graphics, logos, templates, workflows, SOPs, and documentation — is the property of Archers AI Ops LLC and is protected by applicable intellectual property law. You may not reproduce, distribute, or create derivative works from it without our written permission.

Where we deliver custom assets under a service agreement, ownership of those assets is governed by that agreement.

8. Disclaimers

Our website and services are provided "as is" and "as available." We make no warranties, express or implied, regarding results, revenue, lead volume, message deliverability, or search rankings.

Marketing and automation outcomes depend on factors outside our control, including your market, your offer, your responsiveness to leads, and carrier and platform behavior. Past results do not guarantee future results.

9. Limitation of Liability

To the fullest extent permitted by law, Archers AI Ops LLC is not liable for any indirect, incidental, consequential, special, or punitive damages, or for lost profits, lost revenue, or lost business opportunities, arising out of your use of our website or services.

Our total liability for any claim relating to our services will not exceed the amount you paid us in the three months preceding the event giving rise to the claim.

10. Third-Party Platforms

Our services are delivered in part through third-party platforms, including CRM, messaging, telephony, and scheduling providers. We are not responsible for outages, changes, price increases, policy changes, or data handling by those providers. Your use of those platforms may be subject to their own terms.

11. Governing Law

These Terms are governed by the laws of the State of Washington, without regard to its conflict of law provisions. Any dispute will be brought in the state or federal courts located in Snohomish County, Washington.

12. Changes to These Terms

We may update these Terms at any time. The "Last updated" date at the top reflects the most recent revision. Continued use of the site or our services after changes take effect constitutes acceptance.
